As far as music goes, remember that MP3 is simply an audio format and as such has no legal standing. The MP3 format itself is not at issue but rather copying of the music is the issue. What about the RIAA (Recording Industry of America) suing people? The RIAA appears to be targeting subpoenas at users who allow their computers to become ‘Supermodes’. ‘Supermode’ status occurs when you use a file-sharing application such as Kazaa, Grokster, Morpheus, Limewire or any of the other P2P applications available online. ‘Supermode’ is the mode you use to actually share music files with others. Unfortunately, sharing using the Internet has become extremely dangerous. Evaluating, on the other hand, totally Bypasses the Internet and in addition, it also encrypts your data. Why evaluating is legal This system is 100% legal because you are simply evaluating a copy of whatever you download before you decide to make an investment. You also have the right to store your files on a remote server if you are unable to do so from your home and retrieve them at a later date. You also have the right to retrieve a file that you have lost due to a hard drive crash or misplaced serial number. What is illegal is distributing copyrighted material without prior permission. What has caught the attention of the RIAA are the Gnutella Networks where people are passing files back and forth over the Internet. That in itself makes you a sitting duck waiting to go down. You see, this system is an honor system.
